The attached article from Corriere Canadese provides a good summary of the July 3, 2015 Araujo decision in Federal Court.

In principle, the Federal Court will probably continue with the logic of its April 27, 2015 decision. This means that it’s only a matter of time before Mr. Araujo’s landed immigrant file is opened and a positive decision is made that he is successfully economically established in Canada.

It was interesting sitting in the court room listening to the Federal Crown tell the Court that in return for the Court confirming Mr. Araujo’s removal from Canada that the government would compensate Mr. Araujo’s costs and  damages while living in Portugal during the completion of the April 27 , 2015 court process. We will hold Ottawa to its bargain. 

The bottom line in all this is the reality that Ottawa is doing everything to avoid making substituted evaluation decisions on Federal Skilled Trades files. They would rather pay people to live in Portugal than allow these people to pay taxes in Canada.

Since there is no policy based logic to Ottawa refusing to provide substituted evaluation for Carlos Araujo, we have to look elsewhere for Ottawa’s justification. The only possible excuse for Ottawa’s absurd refusal to open Carlos Araujo’s file is the money issue. Ottawa does not want Carlos’ taxes and payroll taxes simply because Ottawa is under pressure from the construction sector to make sure that the illegal worker gravy train keeps rolling along.

We will continue through the legal process to bring Mr. Araujo back to Canada.

At the same time we are opening up a new activity to slow down the gravy train. Hopefully, if we cost the construction sector some aggravation, it may decide to allow the public sector “leadership” to release some trades worker visas. 

Worker Canada will soon be launching its “Pension Pay Back” program. We will encourage former construction sector workers in Portugal to ask for return of their pension contributions.

We’ll see what happens."
